Four years after the fact, a Philadelphia appeals court has overturned the previous decision to fine CBS $550,000 over the Justin Timberlake/ Janet Jackson wardrobe malfunction at the Superbowl in 2004.
Judges said in the ruling that one of the determining factors was that they considered Janet Jackson and Justin Timberlake "independent contractors" and CBS could not be held accountable for their actions.
The Federal Communications Commission smacked CBS with the hefty fine after Timberlake accidentally ripped Janet's top off briefly exposing her breast during the SuperBowl half-time show.
The FCC said that they received 542,000 complaints right after the now infamous wardrobe malfunction, but CBS says most of those came from well organized groups who hold an interest in the topic.
I guess it worked, because now CBS is going to get off the hook. If you ask me, the sensitivity is is gone and that's why no one cares anymore. Out of sight, out of mind!
